Do you employ workers that are temporary or seasonal? What do you do when your primary employee is on vacation? Do these employees work with controlled products (under WHMIS) or Dangerous Goods (under Transport Canada's Transportation of Dangerous Goods Regulations)? Even if they are only intended to be working a short time, they MUST be trained.
Section 42(1) of the Occupational Health and Safety Act requires that the employer educate "a worker exposed or likely to be exposed" to a controlled product. An exposed worker can be defined as an employee who stores, handles, uses or disposes of a controlled product or supervises another worker performing these activities.
Part 6.1 (2) of the Transportation of Dangerous Goods Regulations state that "An employer must not direct or allow an employee to handle, offer for transport or transport dangerous goods unless the employee (a) is adequately trained and hold a training certificate in accordance with this Part; or (b) performs those activities in the presence and under the direct supervision of a person who is adequately training…"
