Cette partie couvre les exigences relatives aux plans d\u2019intervention d\u2019urgence, ou PIU. Vous trouverez les d\u00e9tails sur le site Web du <a href=\"http:\/\/www.gazette.gc.ca\/rp-pr\/p1\/2018\/2018-06-30\/pdf\/g1-15226.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">gouvernement du Canada.<\/a><\/p>\n<p>Les exigences du Canada en mati\u00e8re de PIU sont uniques; elles ne sont pas adopt\u00e9es par les <a href=\"http:\/\/www.unece.org\/fr\/transport\/areas-of-work\/dangerous-goods\/marchandises-dangereuses-accueil.html\" target=\"_blank\" rel=\"noopener noreferrer\">recommandations de l\u2019ONU sur le transport des marchandises dangereuses<\/a>. En r\u00e9sum\u00e9, elles exigent que l\u2019exp\u00e9diteur de quantit\u00e9s importantes de marchandises dangereuses \u00e0 haut risque \u00e9tablisse un protocole pr\u00e9cis, impliquant souvent une \u00e9quipe d\u2019intervention de garde, qui peut aider les intervenants locaux en pr\u00e9sence d\u2019un d\u00e9versement. Transports Canada doit consulter et approuver le plan avant que l\u2019exp\u00e9diteur ne puisse offrir ou importer les envois concern\u00e9s (malgr\u00e9 que l\u2019approbation ne doive \u00eatre \u00e9mise qu\u2019une seule fois). Depuis la <a href=\"https:\/\/en.wikipedia.org\/wiki\/Lac-M%C3%A9gantic_rail_disaster\" target=\"_blank\" rel=\"noopener noreferrer\">trag\u00e9die du Lac-M\u00e9gantics <\/a>urvenue en 2013, l\u2019am\u00e9lioration des exigences relatives aux PIU a fait l\u2019objet d\u2019une pr\u00e9occupation importante de la part de Transports Canada.<\/p>\n<h3>La modification de juin vise quatre objectifs primaires\u00a0:<\/h3>\n<ol>\n<li>Clarifier le processus de mise en \u0153uvre des PIU;<\/li>\n<li>Am\u00e9liorer la pr\u00e9paration et l\u2019intervention d\u2019urgence;<\/li>\n<li>All\u00e9ger le fardeau r\u00e9glementaire pour ceux concern\u00e9s par cette exigence; et<\/li>\n<li>Apporter certains changements g\u00e9n\u00e9raux d\u2019ordre administratif pour maintenir l\u2019harmonisation de toutes les parties du R\u00e8glement.<\/li>\n<\/ol>\n<h2>Clarification de la mise en \u0153uvre des PIU<\/h2>\n<p>Les r\u00e8glements actuels sur la m\u00e9thode de mise en \u0153uvre d\u2019un PIU ne sont pas tr\u00e8s clairs. On pr\u00e9sume que les intervenants d\u2019urgence ou que la personne qui ma\u00eetrise la mati\u00e8re d\u00e9vers\u00e9e seraient responsables du d\u00e9ploiement du PIU, mais cela n\u2019a jamais \u00e9t\u00e9 clairement \u00e9tabli. La modification exige que la personne qui a la \u00ab\u00a0responsabilit\u00e9 ou la ma\u00eetrise\u00a0\u00bb d\u2019une mati\u00e8re d\u00e9vers\u00e9e devant faire l\u2019objet d\u2019un rapport de rejet fasse ce rapport au d\u00e9tenteur du PIU (g\u00e9n\u00e9ralement l\u2019exp\u00e9diteur initial) et lui communique les renseignements n\u00e9cessaires. Une fois le rapport des lieux re\u00e7u, le d\u00e9tenteur du PIU devra prendre les mesures pr\u00e9vues dans le PIU.<\/p>\n<p>&nbsp;<\/p>\n<p>Un nouveau concept de la proposition est que le fait de composer le num\u00e9ro de t\u00e9l\u00e9phone du PIU indiqu\u00e9 sur le document d\u2019exp\u00e9dition n\u2019entra\u00eenera pas n\u00e9cessairement le d\u00e9ploiement de l\u2019\u00e9quipe d\u2019intervention vers les lieux du d\u00e9versement. L\u2019intervention sera plut\u00f4t r\u00e9partie sur deux \u00ab\u00a0paliers\u00a0\u00bb, selon la gravit\u00e9 de l\u2019accident.<\/p>\n<p>Le premier palier impliquerait ce que Transports Canada appelle une intervention \u00ab\u00a0\u00e0 distance\u00a0\u00bb; il s\u2019agit de fournir des conseils au t\u00e9l\u00e9phone et de surveiller la situation. Si la situation semble le n\u00e9cessiter, l\u2019intervention peut passer au deuxi\u00e8me palier; ce qui signifie que l\u2019\u00e9quipe d\u2019intervention d\u2019urgence du PIU sera d\u00e9ploy\u00e9e sur les lieux du d\u00e9versement.<\/p>\n<p>Qu\u2019il s\u2019agisse du premier ou du deuxi\u00e8me palier, le d\u00e9tenteur du PIU devra communiquer par t\u00e9l\u00e9phone avec\u00a0<a href=\"https:\/\/tc.canada.ca\/fr\/marchandises-dangereuses\/canutec\" target=\"_blank\" rel=\"noopener noreferrer\">CANUTEC<\/a>\u00a0d\u00e8s que possible.<\/p>\n<p>&nbsp;<\/p>\n<h2>Am\u00e9lioration de la pr\u00e9paration et de l\u2019intervention d\u2019urgence<\/h2>\n<p>Au moment de la demande d\u2019approbation d\u2019un PIU, le d\u00e9tenteur \u00e9ventuel doit soumettre celle-ci \u00e0 Transports Canada. La modification fournira beaucoup plus de d\u00e9tails sur ce que devra contenir cette demande, notamment une analyse d\u2019incident potentiel couvrant des sc\u00e9narios comme les rejets mineurs, d\u00e9versements majeurs et incendies. Chaque sc\u00e9nario doit faire \u00e9tat des cons\u00e9quences possibles, du palier de l\u2019intervention et de la personne responsable des mesures \u00e0 prendre.<\/p>\n<p>La modification aidera \u00e9galement \u00e0 harmoniser le langage de la partie\u00a07 avec la description des PIU dans la <em>Loi sur le transport des marchandises dangereuses.<\/em>La Loi mentionne actuellement que les personnes qui \u00ab\u00a0manutentionnent\u00a0\u00bb ou \u00ab\u00a0transportent\u00a0\u00bb des marchandises dangereuses dans des quantit\u00e9s exigeant un PIU sont sujettes \u00e0 ces exigences, mais les r\u00e8glements n\u2019abordent presque pas les responsabilit\u00e9s de celles qui \u00ab\u00a0offrent pour le transport\u00a0\u00bb ou qui \u00ab\u00a0importent\u00a0\u00bb de tels envois. La reformulation de la partie\u00a07 tentera de pr\u00e9ciser que les manutentionnaires et transporteurs sont \u00e9galement concern\u00e9s; cela pourrait donc avoir des r\u00e9percussions importantes sur les personnes devant enregistrer le PIU.<\/p>\n<p>&nbsp;<\/p>\n<h2>Att\u00e9nuation du fardeau r\u00e9glementaire<\/h2>\n<p>L\u2019une des principales plaintes concernant les PIU est que ces derniers sont un v\u00e9ritable fardeau pour les exp\u00e9diteurs, entra\u00eenant des d\u00e9penses consid\u00e9rables et une grande confusion en ce qui a trait \u00e0 qui doit obtenir le PIU pour les importations ou les marchandises qui changent de main avant la livraison finale. La modification tentera d\u2019att\u00e9nuer ces exigences en permettant aux \u00ab\u00a0utilisateurs autoris\u00e9s\u00a0\u00bb d\u2019utiliser un PIU d\u00e9j\u00e0 existant et appartenant \u00e0 une personne en lien avec l\u2019envoi, comme le fabricant initial.<\/p>\n<p>Le d\u00e9tenteur du PIU autoris\u00e9 n\u2019aurait plus \u00e0 aviser Transports Canada lorsque qu\u2019une telle entente commence ou arrive \u00e0 terme. La modification permettra \u00e0 un utilisateur autoris\u00e9 d\u2019utiliser le PIU existant si l\u2019utilisateur autoris\u00e9 n\u2019est pas le fabricant des marchandises concern\u00e9es, si le PIU est appliqu\u00e9 dans la zone g\u00e9ographique o\u00f9 l\u2019utilisateur autoris\u00e9 exp\u00e9die ou fait transiter les marchandises, et si le d\u00e9tenteur initial du PIU a accept\u00e9 d\u2019intervenir lors d\u2019incidents impliquant les envois de l\u2019utilisateur autoris\u00e9.<\/p>\n<p>Sachez que lorsqu\u2019un utilisateur autoris\u00e9 \u00ab tire profit\u00a0\u00bb d\u2019un PIU pr\u00e9existant, le document d\u2019exp\u00e9dition doit pr\u00e9ciser le d\u00e9tenteur du PIU initial et comporter la mention \u00ab\u00a0utilis\u00e9 avec l\u2019autorisation de\u00a0\u00bb.<\/p>\n<p>D\u2019autres parties des modifications clarifieront les exigences pour les PIU relatifs aux mati\u00e8res infectieuses qui s\u2019appliqueront \u00e0 tous les pathog\u00e8nes du groupe de risque\u00a04 r\u00e9pertori\u00e9s dans la <a href=\"https:\/\/www.canada.ca\/fr\/sante-publique\/services\/biosecurite-biosurete-laboratoire\/loi-agents-pathogenes-toxines.html\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Loi sur les agents pathog\u00e8nes humains et les toxines<\/em><\/a>, ainsi que la d\u00e9finition de \u00ab\u00a0r\u00e9sidus\u00a0\u00bb en ce qui a trait aux PIU.<\/p>\n<p>&nbsp;<\/p>\n<h2>Changements g\u00e9n\u00e9raux d\u2019ordre administratif<\/h2>\n<p>La modification abordera certains enjeux importants qui existent hors de la partie\u00a07. Le mot \u00ab\u00a0activer\u00a0\u00bb, en lien avec les PIU, sera remplac\u00e9, par exemple, par le mot \u00ab\u00a0mettre en \u0153uvre\u00a0\u00bb. Elle traitera de l\u2019\u00e9cart actuel dans la\u00a0<a href=\"https:\/\/tc.canada.ca\/fr\/marchandises-dangereuses\/partie-8\">partie\u00a08, D\u00e9claration<\/a>; en effet, les marchandises des classes\u00a03, 4, 5, 6.1 et 8 ne sont pas pr\u00e9sentes dans le tableau des quantit\u00e9s \u00e0 d\u00e9clarer si elles n\u2019ont pas de groupe d\u2019emballage. Finalement, la modification clarifie que le num\u00e9ro de t\u00e9l\u00e9phone de la mise en \u0153uvre du PIU doit \u00eatre actif 24\u00a0heures par jour, une omission plut\u00f4t inexplicable \u00e0 ce stade.<\/p>\n<p>&nbsp;<\/p>\n<h2>Faites conna\u00eetre votre opinion!<\/h2>\n<p>Si vous \u00eates concern\u00e9 par les exigences de la partie\u00a07, certaines de ces modifications peuvent vous sembler plus utiles que d\u2019autres.
