The wording implies that when the Dangerous Goods safety marks for packages within the overpack are not visible, the overpack must have an \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">OVERPACK<\/span><\/a><span style=\"font-weight: 400\">\u201d mark displayed. This leads to some additional labelling requirements, particularly for shippers of stretch-wrapped pallet loads.<\/span><\/p>\n<h2>Definition<\/h2>\n<p><span style=\"font-weight: 400\">We\u2019ll pause to review the concept of an overpack, consistent among the various <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/regulations\/\"><span style=\"font-weight: 400\">regulations<\/span><\/a><span style=\"font-weight: 400\"> (e.g. TDG, UN Model Recommendations, IMDG Code, IATA DGR, &amp; 49 CFR).<\/span><br \/>\nAn overpack is a non-standardized packaging that:<\/p>\n<ol>\n<li>Is used for handling convenience (e.g. to reduce multiple handling- I.e. 4 drums on a skid, allowing loading 4 at once rather than 4 trips, or 6 small containers in a \u201cnon-spec\u201d master carton, or 48 small boxes stretch wrapped on a skid; a keg (small drum) in a non-spec box for stability, etc. )<\/li>\n<li>Cannot be used as a replacement for inadequate or damaged, required \u201cstandardized\u201d packaging<\/li>\n<li>Is to be unopened between consignor and receiver<\/li>\n<li>Cannot interfere with the integrity of the standardized packaging (e.g. banding cutting into boxes on a pallet)<\/li>\n<\/ol>\n<p>The common principle requires that the description of <span style=\"font-weight: 400\">Dangerous Goods<\/span> that cannot be seen once the overpack is in place will be reproduced on the outside of the overpack.<\/p>\n<p>However, this could be misleading in that someone seeing the <span style=\"font-weight: 400\">Dangerous Goods<\/span> markings may assume \u201cnon-compliance\u201d when there is no package certification mark on the overpack. Although the situation should be fairly obvious with, for example, a stretch wrapped pallet; a master carton situation could be confusing.<\/p>\n<p><span style=\"font-weight: 400\">Thus, we have the application of the \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack<\/span><\/a><span style=\"font-weight: 400\">\u201d mark to signal that the specification package is inside.<\/span><\/p>\n<h2>Different Strokes<\/h2>\n<p>The system starts to get sticky when the wording used in the different regulations is phrased differently.<\/p>\n<p><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product-category\/publications\/canadian-tdg\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\"> 4.10.1 (1) speaks of \u201cthe marks on small means of containment\u201d- which implies that each package\u2019s markings must be visible to avoid the need to reproduce them on the overpack. Whereas exemptions <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product-category\/publications\/canadian-tdg\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\"> 1.17 (4) \u2013 limited quantity and 1.17.1 (4) \u2013 <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl350n\/\"><span style=\"font-weight: 400\">excepted quantity<\/span><\/a><span style=\"font-weight: 400\"> speaks of \u2018\u2019means of containment\u2019\u2019.\u00a0 The real difference is that a small means of containment implies its size can be less than or equal to 450 L capacity but for the <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/pl-psr80\/\"><span style=\"font-weight: 400\">limited quantities<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl350n\/\"><span style=\"font-weight: 400\">excepted quantities<\/span><\/a><span style=\"font-weight: 400\">, these have their own size limitations within the applicable article.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Other regulations (<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-mancfrm-2020\/\"><span style=\"font-weight: 400\">49 CFR<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-iata20\/\"><span style=\"font-weight: 400\">IATA DGR<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-imo2v18\/\"><span style=\"font-weight: 400\">IMDG Code<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-ghs19\/\"><span style=\"font-weight: 400\">UN Recommendations<\/span><\/a><span style=\"font-weight: 400\">) insert the words \u201crepresentative of\u2026\u201d (all DG or each HazMat) in the overpack. Thus, as long as safety marks representing the individual packages can be seen at least once, there should be no need to reproduce any on the outside of the overpack.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Furthermore, the sequence of the clauses in <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-clrome\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\"> 4.10.1 requires the use of an \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack<\/span><\/a><span style=\"font-weight: 400\">\u201d mark to be used, regardless of the type of overpack whenever the safety marks are not visible from the outside of the overpack.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-ghs19\/\"><span style=\"font-weight: 400\">UN Recommendations<\/span><\/a><span style=\"font-weight: 400\"> where the placement of commas in 5.1.2.1 a) implies that the lead-in requirement for an \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack<\/span><\/a><span style=\"font-weight: 400\">\u201d mark applies when the DG marks are not visible.<\/span><\/p>\n<p><span style=\"font-weight: 400\">As well, both <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-iata20\/\"><span style=\"font-weight: 400\">IATA DGR<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-imo2v18\/\"><span style=\"font-weight: 400\">IMDG Code<\/span><\/a><span style=\"font-weight: 400\"> requires the word \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack<\/span><\/a><span style=\"font-weight: 400\">\u201d to be applied if the DG safety marks are not visible from the outside of the overpack.<\/span><\/p>\n<p><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-mancfrm-2020\/\"><span style=\"font-weight: 400\">49 CFR<\/span><\/a><span style=\"font-weight: 400\"> puts a slightly different spin on things and requires an <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack mark<\/span><\/a><span style=\"font-weight: 400\"> only when DG packages in the overpack which requires a UN specification packaging do not have the marks visible from the outside of the overpack.<\/span><\/p>\n<h2>Size Matters &#8211; Sometimes<\/h2>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-clrome\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-mancfrm-2020\/\"><span style=\"font-weight: 400\">49 CFR<\/span><\/a><span style=\"font-weight: 400\"> both require safety marks on 2 opposite sides if the overpack volume is 1.8 cubic meters (approximately 64 cu.ft.) or more. <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-iata20\/\"><span style=\"font-weight: 400\">IATA DGR<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-imo2v18\/\"><span style=\"font-weight: 400\">IMDG Code<\/span><\/a><span style=\"font-weight: 400\"> are silent on this aspect. All recommend \u201c<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3700\/\"><span style=\"font-weight: 400\">overpack<\/span><\/a><span style=\"font-weight: 400\">\u201d letters to be at least 12 mm high as <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-clrome\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\"> harmonized as of January 1, 2016.<\/span><\/p>\n<h2>Other Markings<\/h2>\n<p><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/lb-usl3000\/\"><span style=\"font-weight: 400\">Orientation arrows<\/span><\/a><span style=\"font-weight: 400\">, as required by all but <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-clrome\/\"><span style=\"font-weight: 400\">TDGR<\/span><\/a><span style=\"font-weight: 400\">, must also be included for liquids. <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-iata20\/\"><span style=\"font-weight: 400\">IATA DGR<\/span><\/a><span style=\"font-weight: 400\"> adds a requirement to assign a unique number to each overpack in a consignment when there is more than one. This numbering system is at the shipper\u2019s discretion, but must be referenced on the \u2018\u2019<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/fm-usf83\/\"><span style=\"font-weight: 400\">Shipper\u2019s Declaration<\/span><\/a><span style=\"font-weight: 400\">\u2019\u2019 for the consignment.<\/span><\/p>\n<h2>Limited\/Excepted Quantities<\/h2>\n<p>Limited and excepted quantities do not require UN specification packaging. However, they do have size limits. For example, a limited quantity package cannot weigh more than 30 kilograms gross, but this would not apply to the overpack as a whole. If you have an overpack such as a crate or skid (which would not be UN specification) handlers could mistake the overpack itself for a exempted package and reject it as too big.<\/p>\n<p>Therefore, TDGR 1.17(4) requires overpacks of limited quantities to display the \u201cOVERPACK\u201d mark as well as the limited quantity mark (unless, of course, the packages with at least one visible limited quantity mark are visible through the overpack.)
