Cette modification vise \u00e0 mieux harmoniser les r\u00e8glements du Canada \u00e0 ceux utilis\u00e9s pour les envois internationaux, simplifiant ainsi le transport international et am\u00e9liorant la s\u00e9curit\u00e9. Sachez qu\u2019il s\u2019agit d\u2019une modification distincte de celle publi\u00e9e en m\u00eame temps concernant les indications de danger.<\/p>\n<p>La premi\u00e8re chose que vous remarquerez dans cette modification est la r\u00e9vision exhaustive du tableau de la section 1.3.1, tableau des documents sur les normes de s\u00e9curit\u00e9 et les r\u00e8gles de s\u00e9curit\u00e9. Plusieurs r\u00e9f\u00e9rences normalis\u00e9es ont \u00e9t\u00e9 modifi\u00e9es pour des versions plus actuelles; l\u2019une des mises \u00e0 jour les plus importantes \u00e9tant le nouveau renvoi \u00e0 la dix-septi\u00e8me \u00e9dition (2011) des recommandations de l\u2019ONU sur le transport des marchandises dangereuses. De plus, certaines normes ont \u00e9t\u00e9 supprim\u00e9es, comme la CAN\/CGSB 43.150, \u00ab Exigences de rendement des emballages destin\u00e9s au transport des marchandises dangereuses \u00bb, de l\u2019Office des normes g\u00e9n\u00e9rales du Canada. En remplacement, de nouvelles normes comme la TP14850 de Transports Canada, \u00ab Petits contenants pour le transport des marchandises dangereuses des classes 3, 4, 5, 6.1, 8 et 9\u00bb, ont \u00e9t\u00e9 ajout\u00e9es. Cela cr\u00e9era un tout nouveau syst\u00e8me de s\u00e9lection des emballages pour ces classes. D\u2019autres nouvelles normes introduiront des dispositions d\u2019emballage UN pour les r\u00e9servoirs portatifs et les conteneurs ferroviaires.<\/p>\n<p>Les normes n\u2019ont toutefois pas toutes \u00e9t\u00e9 mises \u00e0 jour. Sachez, par exemple, que la norme CAN\/CGSB 43.125, \u00ab Conditionnement des mati\u00e8res infectieuses, des \u00e9chantillons de diagnostic, des produits biologiques et des d\u00e9chets biom\u00e9dicaux en vue du transport \u00bb, continue \u00e0 renvoyer \u00e0 la norme de 1999 et non aux mises \u00e0 jour subs\u00e9quentes qui ont \u00e9t\u00e9 effectu\u00e9es sur cette derni\u00e8re.<\/p>\n<p>Plusieurs exp\u00e9diteurs internationaux seront inquiets de l\u2019abrogation de la section 1.10, laquelle permettait l\u2019utilisation des descriptions d\u2019exp\u00e9dition provenant des recommandations de l\u2019ONU, des instructions techniques pour la s\u00e9curit\u00e9 du transport a\u00e9rien des marchandises dangereuses de l\u2019OACI, et du code IMDG. Cette derni\u00e8re s\u2019av\u00e9rait inestimable en permettant aux personnes d\u2019exp\u00e9dier des marchandises \u00e0 l\u2019aide de descriptions qui ne se trouvaient pas encore dans l\u2019annexe 1 du TMD. Par chance, dans les nouvelles modifications, des dispositions pour utiliser des descriptions internationales se retrouvent maintenant dans la section 2.2(4).<\/p>\n<p>L\u2019un des changements les plus importants aux r\u00e8glements actuels sera l\u2019ajout d\u2019une nouvelle section dans la partie 2, Classification. Cette section, 2.2.1, exige que tous les exp\u00e9diteurs, qui offrent des marchandises dangereuses \u00e0 des transporteurs ou qui importent des marchandises dangereuses au Canada, conservent une \u00ab preuve de classification \u00bb \u00e0 la disposition de Transports Canada.<\/p>\n<p>Cette preuve peut comprendre :<\/p>\n<p>&nbsp;<\/p>\n<ul>\n<li>un rapport d\u2019\u00e9preuves;<\/li>\n<li>un rapport de laboratoire, ou<\/li>\n<li>un document qui explique comment les marchandises dangereuses ont \u00e9t\u00e9 class\u00e9es.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>La documentation doit \u00eatre conserv\u00e9e par le l\u2019exp\u00e9diteur pendant au moins cinq ans.<\/p>\n<p>Un autre changement majeur se trouve \u00e0 la partie 3, Documentation. \u00c0 compter du 15 juillet 2015, une nouvelle section, soit la 3.6.1, exigera que tous les documents d\u2019exp\u00e9dition renferment une d\u00e9claration sign\u00e9e. Pour les envois non r\u00e9gis par d\u2019autres r\u00e8glements, l\u2019\u00e9nonc\u00e9 doit se lire comme suit :<\/p>\n<p>Je d\u00e9clare que le contenu de ce chargement est d\u00e9crit ci-dessus de fa\u00e7on compl\u00e8te et exacte par l\u2019appellation r\u00e9glementaire ad\u00e9quate et qu\u2019il est convenablement classifi\u00e9, emball\u00e9 et muni d\u2019indications de danger de marchandises dangereuses et \u00e0 tous \u00e9gards bien conditionn\u00e9 pour \u00eatre transport\u00e9 conform\u00e9ment au R\u00e8glement sur le transport des marchandises dangereuses.<\/p>\n<blockquote><p>Cette d\u00e9claration doit \u00eatre sign\u00e9e ou autoris\u00e9e par l\u2019exp\u00e9diteur, ou par une personne agissant en son nom. Aucune signature manuscrite n\u2019est cependant exig\u00e9e; le document doit simplement \u00ab stipul\u00e9 le nom de la personne \u00bb. Cette exigence ne s\u2019applique pas lors du retour de grands contenants, ayant contenus des marchandises dangereuses, mais qui ont depuis \u00e9t\u00e9 nettoy\u00e9s ou purg\u00e9s.<\/p><\/blockquote>\n<p>La partie 5 du TMD, Contenants, a \u00e9t\u00e9 r\u00e9vis\u00e9e de mani\u00e8re exhaustive, afin de faire les renvois aux nouvelles normes d\u2019emballage diverses et \u00e0 la fa\u00e7on de les utiliser pour s\u00e9lectionner l\u2019emballage appropri\u00e9. L\u2019un des points d\u2019int\u00e9r\u00eat est que les exigences d\u2019emballage pour la classification UN1950, A\u00c9ROSOLS, s\u2019appliquera dor\u00e9navant \u00e0 la classification UN2037, CARTOUCHES \u00c0 GAZ. Sachez que les nouvelles normes d\u2019emballage de TC, comme la TP14850, seront offertes gratuitement en ligne, contrairement aux normes de l\u2019ONGC ou de l\u2019Association canadienne de normalisation (CSA) qui devront \u00eatre achet\u00e9es.<\/p>\n<p>Un nombre de changements mineurs ont \u00e9t\u00e9 apport\u00e9s aux parties portant sur le transport modal, soient les parties 9 \u00e0 12. Par exemple, les dispositions pour l\u2019exp\u00e9dition de marchandises par voie a\u00e9rienne en vertu des dispositions de l\u2019OACI pour les biens de consommation ont \u00e9t\u00e9 mises \u00e0 jour pour renvoyer \u00e0 l\u2019instruction d\u2019emballage Y963 actuelle plut\u00f4t qu\u2019\u00e0 l\u2019instruction d\u00e9su\u00e8te 910.<\/p>\n<p>L\u2019annexe 1 a \u00e9t\u00e9 modifi\u00e9e \u00e0 certains endroits, principalement par l\u2019ajout ou le retrait de dispositions particuli\u00e8res. L\u2019entr\u00e9e pour la classification UN3166, MOTEUR \u00c0 COMBUSTION INTERNE ou V\u00c9HICULE \u00c0 PROPULSION PAR GAZ INFLAMMABLE ou V\u00c9HICULE \u00c0 PROPULSION PAR LIQUIDE INFLAMMABLE a \u00e9t\u00e9 \u00e9largie pour y inclure les v\u00e9hicules et la machinerie \u00e0 propulsion par piles \u00e0 combustible.<\/p>\n<p>Dans l\u2019annexe 2, les dispositions particuli\u00e8res 26, 80, 81 et 89 ont \u00e9t\u00e9 retir\u00e9es. La disposition particuli\u00e8re 90 a \u00e9t\u00e9 ajout\u00e9e; elle concerne les combustibles comme l\u2019essence ou le fioul transport\u00e9s dans des citernes soud\u00e9s. Un autre ajout concerne la disposition particuli\u00e8re 92, laquelle exige que les personnes qui exp\u00e9dient des mati\u00e8res UN1267, P\u00c9TROLE BRUT et UN1268, PRODUITS P\u00c9TROLIERS, N.S.A., classifient ces produits sur la base d\u2019\u00e9chantillons et qu\u2019elles conservent les donn\u00e9es des proc\u00e9dures d\u2019\u00e9chantillonnage \u00e0 la disponibilit\u00e9 de Transports Canada.<\/p>\n<p>Le texte de la modification se trouve <a href=\"https:\/\/www.gazette.gc.ca\/rp-pr\/p2\/2014\/2014-07-02\/html\/sor-dors152-fra.php\" target=\"new\" rel=\"noopener noreferrer\">ici<\/a>. She is fluent in various US, Canadian, and international regulations involving transportation, including TDG, 49 CFR, ICAO, IMDG, and the ADR\/RID. She also specializes in the hazard communication standards of OSHA, WHMIS, CCCR, and the Globally Harmonized System for Classification and Labelling (GHS). Barbara is the author of ICC\u2019s TDG Clear Language Driver and Handler\u2019s Guide.
