{"id":5424,"date":"2015-08-25T09:00:38","date_gmt":"2015-08-25T13:00:38","guid":{"rendered":"http:\/\/regulatory.blog\/?p=5424"},"modified":"2015-08-25T09:00:38","modified_gmt":"2015-08-25T13:00:38","slug":"exemption-relative-a-une-masse-brute-de-500-kilogrammes","status":"publish","type":"post","link":"https:\/\/www.thecompliancecenter.com\/ca\/help-center\/articles\/exemption-relative-a-une-masse-brute-de-500-kilogrammes\/","title":{"rendered":"Exemption relative \u00e0 une masse brute de 500 kilogrammes"},"content":{"rendered":"<p>Comme la plupart des r\u00e8glements bas\u00e9s sur les recommandations de l\u2019ONU pour le transport des marchandises dangereuses, le R\u00e8glement sur le transport des marchandises dangereuses (RTMD) du Canada comprend de nombreuses exemptions. Ces derni\u00e8res permettent d\u2019exp\u00e9dier plus facilement et \u00e0 moindre co\u00fbt des mati\u00e8res \u00e0 faible risque. Toutefois, chaque exemption doit \u00eatre \u00e9tudi\u00e9e attentivement. Si vous ne satisfaites pas toutes les exigences, vous n\u2019avez droit \u00e0 aucune des portions de l\u2019exemption.<\/p>\n<p>L\u2019une des exemptions la moins comprise dans le TMD se trouve \u00e0 l\u2019article 1.16, soit \u00ab l\u2019exemption relative \u00e0 une masse brute de 500 kilogrammes \u00bb. Les dispositions de cet article remontent il y a longtemps \u00e0 une s\u00e9rie de permis visant \u00e0 faciliter les envois de petites quantit\u00e9s de marchandises dangereuses. Au cours des ann\u00e9es, des changements apport\u00e9s \u00e0 cet article ont r\u00e9duit son efficacit\u00e9. Cette exemption peut encore \u00eatre utile dans certains cas pr\u00e9cis, mais elle doit \u00eatre utilis\u00e9e de mani\u00e8re appropri\u00e9e.<\/p>\n<p>Le premier mythe concernant l\u2019exemption de 500 kilogrammes est qu\u2019il s\u2019agit d\u2019une exemption totale de toutes les exigences du TMD. Cela est totalement faux. Au mieux, l\u2019exemption lib\u00e8re l\u2019exp\u00e9diteur de la partie 3 (documentation), de la partie 4 (indications de danger des marchandises dangereuses) et de la partie 5 (contenants). Toutes les autres exigences du TMD demeurent en vigueur. Celles-ci, comprennent, par exemple, que le transporteur ainsi que tous les manutentionnaires doivent \u00eatre certifi\u00e9s pour le TMD. \u00c0 un certain moment, les destinataires \u00e9taient exempt\u00e9s de la partie 6 (formation), mais cette d\u00e9livrance a \u00e9t\u00e9 annul\u00e9e lors d\u2019une modification il y a d\u00e9j\u00e0 plusieurs ann\u00e9es.<\/p>\n<p>\u00c9videmment, l\u2019exemption s\u2019applique uniquement si le total de toutes les marchandises dangereuses \u00e0 bord ne surpasse pas 500 kilogrammes. Malgr\u00e9 que l\u2019article 1.16 n\u2019en fait pas directement mention, l\u2019interpr\u00e9tation de Transports Canada a toujours \u00e9t\u00e9 que cette quantit\u00e9 comprendrait les quantit\u00e9s limit\u00e9es en vertu de l\u2019article 1.17 et autres marchandises exempt\u00e9es. Par cons\u00e9quent, si vous avez 300 kilogrammes de mati\u00e8res r\u00e9glement\u00e9es et 400 kilogrammes de quantit\u00e9s limit\u00e9es \u00e0 bord, vous ne pourriez pas utiliser cette exemption.<\/p>\n<p>Le poids est limit\u00e9 \u00e0 30 kilogrammes ou moins pour les classes autres que la classe 2. Les emballages pour les liquides et solides ne doivent pas \u00eatre homologu\u00e9s UN, mais les contenants de gaz doivent satisfaire aux normes \u00e9tablies \u00e0 la partie 5 (contenants). Les emballages non certifi\u00e9s doivent \u00eatre con\u00e7us, fabriqu\u00e9s, remplis, ferm\u00e9s, s\u00e9curis\u00e9s et fix\u00e9s de mani\u00e8re \u00e0 ne pas fuir pendant des conditions de transport normales.<\/p>\n<p>Une fois le poids total de l\u2019envoi et le poids des emballages individuels v\u00e9rifi\u00e9s, nous pouvons nous concentrer sur la communication des dangers. Les emballages eux-m\u00eames doivent arbor\u00e9s les indications et \u00e9tiquettes au m\u00eame titre que les marchandises dangereuses r\u00e9guli\u00e8res, et ce, en vertu de la partie 4. Toutefois, ils peuvent arborer alternativement les \u00e9tiquettes requises par les r\u00e8glements en vertu de la Loi sur les produits dangereux et la Loi sur les produits antiparasitaires. Cela permettrait aux emballages de ne pas afficher les indications et \u00e9tiquettes du TMD si une \u00e9tiquette du SIMDUT ou du R\u00e8glement sur les produits antiparasitaires est visible \u00e0 l\u2019ext\u00e9rieur.<\/p>\n<p>Sachez que lorsque cet article fut initialement r\u00e9dig\u00e9, les \u00e9tiquettes pour les produits de consommation dangereux \u00e9taient \u00e9galement acceptables puisque le R\u00e8glement sur les produits chimiques et contenants de consommation (RPCCC 2001) relevait de la Loi sur les produits dangereux. Toutefois, le RPCCC 2001 a par la suite \u00e9t\u00e9 d\u00e9plac\u00e9 pour relever de la Loi canadienne sur la s\u00e9curit\u00e9 des produits de consommation. Transports Canada n\u2019a jamais mis \u00e0 jour l\u2019article 1.16 pour rem\u00e9dier \u00e0 cette situation, ainsi les \u00e9tiquettes destin\u00e9es aux consommateurs ne doivent pas \u00eatre utilis\u00e9es pour tenter de satisfaire l\u2019article 1.16.<\/p>\n<p>Nous parvenons ensuite aux exigences du document d\u2019exp\u00e9dition. Voil\u00e0 o\u00f9 l\u2019exemption donne encore une souplesse utile : au lieu d\u2019utiliser un document d\u2019exp\u00e9dition normal, avec ses nombreuses exigences, le papier d\u2019exp\u00e9dition en vertu de l\u2019exemption de 500 kilogrammes requiert pratiquement que l\u2019indication de la classe des marchandises dangereuses et la quantit\u00e9 de contenants pour cette classe. Le libell\u00e9 \u00e0 utiliser est pr\u00e9cis\u00e9ment \u00ab classe X, quantit\u00e9 de contenants Y \u00bb. Le r\u00e8glement offre un exemple d\u2019un envoi comportant dix emballages de la classe 3 et 12 emballages de la classe 8, qui va comme suit :<\/p>\n<p>    Classe 3, quantit\u00e9 de contenants, 10<br \/>\n    Classe 8, quantit\u00e9 de contenants, 12<\/p>\n<p>Les autres exigences, comme le poids total \u00e0 bord et la date de l\u2019envoi, ne s\u2019appliquent pas. Cela s\u2019av\u00e8re utile, par exemple, pour des marchandises comme des fournitures de travail qui sont conserv\u00e9s en permanence dans un v\u00e9hicule, mais qui ne satisfont pas d\u2019autres exemptions. Le document peut \u00eatre r\u00e9dig\u00e9 pour la quantit\u00e9 r\u00e9guli\u00e8re des fournitures et laiss\u00e9 dans le v\u00e9hicule de mani\u00e8re permanente.<\/p>\n<p>Puisque l\u2019envoi est exempt\u00e9 de tout ce qui concerne la partie 4, les indications de danger des marchandises dangereuses et les plaques ne sont pas requises, m\u00eame si l\u2019envoi comporte des marchandises qui exigeraient le placardage pour toute quantit\u00e9.<\/p>\n<p>Ce ne sont pas toutes les sortes de marchandises dangereuses qui peuvent \u00eatre transport\u00e9es en vertu de cette exemption. L\u2019article 1.16(2) r\u00e9pertorie diverses classes de marchandises qui ne peuvent utiliser cette exemption. Elles comprennent la plupart des explosifs (sauf ceux de la classe 1.4S), mati\u00e8res radioactives, mati\u00e8res infectieuses, gaz toxiques et mati\u00e8res toxiques liquides du groupe d\u2019emballage I, mati\u00e8res de la classe 4.2 ou 4.3 du groupe d\u2019emballage I, gaz de la classe 2.1 si ceux-ci sont contenus dans des bouteilles surpassant 46 litres, et les mati\u00e8res de la classe 5.2 dont le transport \u00e0 titre de quantit\u00e9s limit\u00e9es est interdit. En outre, toute mati\u00e8re exigeant un plan d\u2019intervention d\u2019urgence (PIU) ou des temp\u00e9ratures de r\u00e9gulation et critiques ne peut \u00eatre exp\u00e9di\u00e9e en vertu de ces dispositions.<\/p>\n<p>Autrement dit, il s\u2019agit d\u2019un nombre impressionnant de conditions pr\u00e9cises pour une exemption, provenant probablement de son origine qui \u00e9tait un permis con\u00e7u pour une situation pr\u00e9cise. De plus, certains des avantages li\u00e9s \u00e0 son utilisation ont \u00e9t\u00e9 \u00e9limin\u00e9s avec le temps. Toutefois, si vous cherchez une fa\u00e7on, par exemple, de charger plusieurs seaux de peinture de 20 litres dans un v\u00e9hicule, cela \u00e9liminerait l\u2019exigence d\u2019utiliser des emballages homologu\u00e9s UN ou de remplir un document d\u2019exp\u00e9dition int\u00e9gral. Vous n\u2019auriez m\u00eame pas besoin d\u2019apposer des \u00e9tiquettes du TDM sur les seaux si ceux-ci arborent les \u00e9tiquettes du SIMDUT. Pour certains exp\u00e9diteurs, ces avantages valent le co\u00fbt d\u2019utiliser l\u2019article 1.16.<\/p>\n<p>N\u2019oubliez pas toutefois que simplement parce que votre envoi \u00e9quivaut \u00e0 moins de 500 kilogrammes, vous n\u2019avez pas \u00e0 utiliser ces dispositions. Barbara is the author of ICC\u2019s TDG Clear Language Driver and Handler\u2019s Guide.
