En gros, les responsabilit\u00e9s au TMD reviennent aux diff\u00e9rents intervenants dans le processus de transport mais les quatre nomm\u00e9s dans le TMD sont: manutention, demande de transport, exp\u00e9diteur (inclus importateur) et transport.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Il est \u00e9vident que l\u2019exp\u00e9diteur est celui qui d\u00e9tient la majorit\u00e9 des responsabilit\u00e9s et pour d\u00e9montrer ceci, voici les plus importantes :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Exigences de formation<\/span><\/li>\n<li><span style=\"font-weight: 400\">Identification et classification des marchandises dangereuses<\/span><\/li>\n<li><span style=\"font-weight: 400\">S\u00e9lection du contenant<\/span><\/li>\n<li><span style=\"font-weight: 400\">Exigences d\u2019emballage et instructions d\u2019emballage<\/span><\/li>\n<li><span style=\"font-weight: 400\">Plan d\u2019intervention d\u2019urgence (lorsqu\u2019applicable) &#8211; PIU<\/span><\/li>\n<li><span style=\"font-weight: 400\">Marquage &amp; \u00c9tiquetage des contenants<\/span><\/li>\n<li><span style=\"font-weight: 400\">Remises des plaques requises sur les grands contenants<\/span><\/li>\n<li><span style=\"font-weight: 400\">\u00c9tablissement du document d\u2019exp\u00e9dition<\/span><\/li>\n<li><span style=\"font-weight: 400\">Rapport en cas de rejets<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Maintenant, proc\u00e9dons \u00e0 vous poser une petite question.<\/span><\/p>\n<p><span style=\"font-weight: 400\">D\u2019apr\u00e8s vous, de la liste des responsabilit\u00e9s les plus importantes ci-haut mentionn\u00e9es, laquelle selon vous est l\u2019infraction la plus commun\u00e9ment rencontr\u00e9e par les inspecteurs de TC?<\/span><\/p>\n<p><span style=\"font-weight: 400\">a)<\/span><span style=\"font-weight: 400\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400\">Exigences de formation<br \/>\n<\/span><span style=\"font-weight: 400\">b)<\/span><span style=\"font-weight: 400\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400\">Classification des marchandises dangereuses<br \/>\n<\/span><span style=\"font-weight: 400\">c)<\/span><span style=\"font-weight: 400\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400\">S\u00e9lection du contenant<\/span><span style=\"font-weight: 400\">d<br \/>\nd)<\/span><span style=\"font-weight: 400\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400\">Marquage &amp; \u00c9tiquetage<br \/>\n<\/span><span style=\"font-weight: 400\">e)<\/span><span style=\"font-weight: 400\"> \u00a0 \u00a0 <\/span><span style=\"font-weight: 400\">Document d\u2019exp\u00e9dition<\/span><\/p>\n<p><span style=\"font-weight: 400\">Si vous avez r\u00e9pondu e), vous avez la bonne r\u00e9ponse ! Et oui, de toutes les infractions commises par les exp\u00e9diteurs, c\u2019est le document d\u2019exp\u00e9dition qui repr\u00e9sente la plus grande difficult\u00e9 du point de vue conformit\u00e9 au TMD. \u00c0 lui seul, cet \u00e9l\u00e9ment de non-conformit\u00e9 repr\u00e9sentait <\/span><b>36 % des cas d\u2019infractions<\/b><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Pourtant, si une personne poss\u00e8de une formation ad\u00e9quate selon ses fonctions et responsabilit\u00e9s, elle devrait \u00eatre en mesure de compl\u00e9ter ce document en bonne et due forme.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">R\u00e9visons ensemble les renseignements qui sont obligatoires d\u2019appara\u00eetre sur le document d\u2019exp\u00e9dition.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Pour savoir ce qui est requis, il faut se r\u00e9f\u00e9rer \u00e0 la partie 3 du TMD \u00e0 l\u2019article 3.5.<\/span><\/p>\n<p><span style=\"font-weight: 400\">D\u00e9butons par dire qu\u2019il n\u2019existe aucun format obligatoire. Le document peut \u00eatre compl\u00e9ter en anglais ou en fran\u00e7ais pour une exp\u00e9dition domestique et les informations doivent \u00eatre lisible et ind\u00e9l\u00e9bile. Il existe une exigence et un format sp\u00e9cifique par contre pour les envois par voie a\u00e9rienne.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Donc, le document doit comporter au minimum les renseignements suivants:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Nom et adresse de l\u2019exp\u00e9diteur (endroit physique d\u2019o\u00f9 quitte les marchandises dangereuses)<\/span><\/li>\n<li><span style=\"font-weight: 400\">Date de la remise au transport<\/span><\/li>\n<li><span style=\"font-weight: 400\">Num\u00e9ro de t\u00e9l\u00e9phone d\u2019urgence en cas d\u2019incident \u00e0 la suite de la mention: <\/span><span style=\"font-weight: 400\">Num\u00e9ro 24-Heures XXX-XXX-XXXX<\/span><\/li>\n<li><span style=\"font-weight: 400\">Le document doit comporter une attestation de l\u2019exp\u00e9diteur (d\u00e9claration de responsabilit\u00e9)<\/span><\/li>\n<li><span style=\"font-weight: 400\">Le document doit comporter le nom de l\u2019individu qui a compl\u00e9t\u00e9 le document d\u2019exp\u00e9dition (en lettres moul\u00e9es mais la signature n\u2019est pas requise)<\/span><\/li>\n<li><span style=\"font-weight: 400\">La description des marchandises dangereuses selon l\u2019ordre sp\u00e9cifique requise par le TMD:<\/span>\n<ul>\n<li><span style=\"font-weight: 400\">Num\u00e9ro UN pr\u00e9c\u00e9d\u00e9 du pr\u00e9fixe UN<\/span><\/li>\n<li><span style=\"font-weight: 400\">Appellation r\u00e9glementaire (+ appellation technique entre parenth\u00e8se si la MD poss\u00e8de la disposition particuli\u00e8re num\u00e9ro 16 dans la colonne 5 de l\u2019annexe 1 du TMD) et le r\u00e8glement demande le nom de la mati\u00e8re qui repr\u00e9sente le plus grand danger)<\/span><\/li>\n<li><span style=\"font-weight: 400\">Classe de danger primaire (et subsidiaire entre parenth\u00e8ses &#8211; si applicable)<\/span><\/li>\n<li><span style=\"font-weight: 400\">Groupe d\u2019emballage en chiffre romain (s\u2019applique aux classes 1, 3, 4, 5, 6.1, 8 et 9)<\/span><\/li>\n<li><span style=\"font-weight: 400\">La mention <\/span><span style=\"font-weight: 400\">\u00ab toxique par inhalation \u00bb si la disposition particuli\u00e8re 23 s\u2019applique<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400\">Le nombre de contenants pour chaque appellation r\u00e9glementaire\u00a0<\/span><span style=\"font-weight: 400\">(le type d\u2019emballage n\u2019est requis au Canada)<\/span><\/li>\n<li><span style=\"font-weight: 400\">La quantit\u00e9 totale et l\u2019unit\u00e9 de mesure (SI) pour chaque marchandise dangereuse d\u00e9crite <\/span><span style=\"font-weight: 400\">(sauf pour les explosifs qui doivent \u00eatre exprim\u00e9e en quantit\u00e9s nette d\u2019explosifs)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Pour vous aider, ci-dessous, un exemple d\u2019un document d\u2019exp\u00e9dition comportant les renseignements TMD:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Num\u00e9ro du plan d\u2019intervention d\u2019urgence et le num\u00e9ro de t\u00e9l\u00e9phone associ\u00e9 au PIU<\/span><\/li>\n<li><span style=\"font-weight: 400\">Point d\u2019\u00e9clair lorsqu\u2019en transport maritime<\/span><\/li>\n<li><span style=\"font-weight: 400\">La mention \u2018\u2019Polluant marin\u2019\u2019 ou s\u2019il s\u2019agit d\u2019un pesticide qui est polluant, le nom et la concentration de la mati\u00e8re active<\/span><\/li>\n<li><span style=\"font-weight: 400\">Dans le cas que la MD requiert une temp\u00e9rature de r\u00e9gulation et critique (applicable pour certaines MD de la classe 4.1 et 5.2)<\/span><\/li>\n<li><span style=\"font-weight: 400\">Tout renseignements suppl\u00e9mentaires applicables aux mati\u00e8res radioactives<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Pour vous aider, ci-dessous, un exemple d\u2019un document
