{"id":734259,"date":"2021-02-05T07:00:38","date_gmt":"2021-02-05T12:00:38","guid":{"rendered":"https:\/\/www.thecompliancecenter.com\/ca\/?p=734259"},"modified":"2021-02-05T07:35:52","modified_gmt":"2021-02-05T12:35:52","slug":"health-canada-prepares-update-to-whmis2015","status":"publish","type":"post","link":"https:\/\/www.thecompliancecenter.com\/ca\/help-center\/articles\/health-canada-prepares-update-to-whmis2015\/","title":{"rendered":"Health Canada Prepares Update to WHMIS2015"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-857920\" src=\"https:\/\/www.thecompliancecenter.com\/wp-content\/uploads\/2021\/02\/ICC_WHMIS2015Update_Blog_2-2021.png\" alt=\"\" width=\"1001\" height=\"301\" \/><\/p>\n<p><a href=\"https:\/\/www.canada.ca\/en\/health-canada\/services\/environmental-workplace-health\/occupational-health-safety\/workplace-hazardous-materials-information-system.html\" target=\"_blank\" rel=\"noopener noreferrer\">WHMIS2015<\/a><span style=\"font-weight: 400\"> (\u201cWorkplace Hazardous Materials Information System, 2015\u201d) has been in place since, well, 2015. Over the past half-decade, the Canadian industry has worked to adjust to the new way of handling hazard communication for workplace chemicals. The standard now is based on the <em><a href=\"https:\/\/unece.org\/ghs-rev5-2013\" target=\"_blank\" rel=\"noopener noreferrer\">Globally Harmonized System of Classification and Labelling, 5th Revision<\/a><\/em><\/span><span style=\"font-weight: 400\">, known more simply as the GHS or sometimes, based on its cover, as the Purple Book. But since WHMIS2015 came into effect, the GHS has moved onward. Now, Health Canada, the department in charge of implementing WHMIS, will play a bit of \u201ccatch up\u201d in an amendment aimed at leaping forward to the 7<\/span><span style=\"font-weight: 400\">th<\/span><span style=\"font-weight: 400\"> Revision of the GHS.<\/span><\/p>\n<p><span style=\"font-weight: 400\">On December 19, 2020, Health Canada published <a href=\"http:\/\/gazette.gc.ca\/rp-pr\/p1\/2020\/2020-12-19\/pdf\/g1-15451.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;Regulation Amending the Hazardous Products Regulations (GHS, Seventh Revised Edition)&#8221;<\/a><\/span><span style=\"font-weight: 400\"> in <em><a href=\"http:\/\/www.gazette.gc.ca\/accueil-home-eng.html\" target=\"_blank\" rel=\"noopener noreferrer\">Canada Gazette I<\/a><\/em><\/span><span style=\"font-weight: 400\">. If you\u2019re not familiar with the Canadian regulatory system, this is a proposed amendment. Publication is followed by a comment period, and the amendment may be revised based on public feedback. The amendment becomes official once it is published in <\/span><i><span style=\"font-weight: 400\">Canada Gazette II<\/span><\/i><span style=\"font-weight: 400\">. For this amendment, that\u2019s hoped to be in the next few months. When Gazette II publishes the amendment, the current \u201c<a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/regulations\/sor-2015-17\/index.html\" target=\"_blank\" rel=\"noopener noreferrer\">Hazardous Products Regulations<\/a><\/span><span style=\"font-weight: 400\">\u201d (HPR), under the <\/span><i><span style=\"font-weight: 400\">Hazardous Products Act<\/span><\/i><span style=\"font-weight: 400\">, will be updated. However, there is likely to be a significant transition period to allow Canadian industry time to adjust.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Unlike the massive change to WHMIS that happened in 2015, when the whole previous system for classification and hazard communication was scrapped and replaced by a GHS-compliant one, the changes in this amendment are much less far-reaching. However, over the years since the 5<\/span><span style=\"font-weight: 400\">th<\/span><span style=\"font-weight: 400\"> revision, the <a href=\"https:\/\/www.hse.gov.uk\/chemical-classification\/get-involved\/un-ghs-sub-committee-unsceghs.htm\" target=\"_blank\" rel=\"noopener noreferrer\">UN Subcommittee of Experts on GHS<\/a><\/span><span style=\"font-weight: 400\">\u00a0has tried to address a number of issues to make the system both more effective in identifying hazards and easier to use. So, the new amendment is likely to be good news in the long run for distributors of hazardous products, even if there will be the short-term pain of some changes to the classification of some products, as well as labels and Safety Data Sheets (SDSs).<\/span><\/p>\n<p><span style=\"font-weight: 400\">Proposed changes include:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">Adopting a new hazard category for non-flammable aerosols. This has been a significant gap in the current classification system, where only flammable aerosols got their own hazard class. The class would be changed to \u201cAerosols,\u201d and non-flammable aerosols would be classified as Category 3. Guidance would be provided that such articles would not have to be classified as well under \u201cGases under Pressure.\u201d<\/span><\/li>\n<li><span style=\"font-weight: 400\">Adjusting subcategories for \u201cFlammable Gases.\u201d<\/span><\/li>\n<li><span style=\"font-weight: 400\">Adding new definitions for pyrophoric and unstable gases.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Adding a new test procedure for Oxidizing Solids.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Updating the definitions for the following to match the GHS 7<\/span><span style=\"font-weight: 400\">th<\/span><span style=\"font-weight: 400\"> Revision &#8211; acute toxicity, skin corrosion, skin irritation, serious eye damage, eye irritation, respiratory sensitization, skin sensitization, and reproductive toxicity.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Adding new definitions for germ cell mutagenicity and carcinogenicity.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Clarifying topics such as animal testing, water-activated toxicants, labels for laboratory samples, and classification of organic peroxides and Specific Target Organ Toxicants.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Allowing the combining of hazard statements and precautionary statements and the omission of non-applicable precautionary statements, currently mentioned only for labels, to also apply to SDSs and permitting the rules for reduced labels on small containers to apply to SDSs.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Allowing for narrower concentration ranges to be used for ingredients on SDSs, as long as they fall within prescribed ranges established in the HPR.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Requiring that when a supplier is required to provide, obtain, or prepare a written document, the written document must provide the changes to the safety data sheet and\/or label resulting from the significant new data, rather than the new studies or data themselves.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Amending provisions on hazard communication for combustible dusts and water-activated toxicants.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Adding \u201cParticle characteristics\u201d as a required specific element in Section 9, Physical Properties on the SDS. This information is considered important by European regulators and will help with harmonization with Europe.<\/span><\/li>\n<li><span style=\"font-weight: 400\">Amending item 3 of Schedule 1 to the HPR to specify that all hazardous ingredients present in a mixture at concentrations above the relevant cut-off levels must be disclosed, regardless of whether the hazardous ingredient contributes to the classification of the mixture as a hazardous product.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">In addition, Health Canada plans to amend Schedule 2 of the <em><a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/h-3\/\" target=\"_blank\" rel=\"noopener noreferrer\">Hazardous Products Act<\/a><\/em><\/span><span style=\"font-weight: 400\">\u00a0to reflect the new classifications established by this amendment.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Still, after all this work, Canada won\u2019t be completely caught up. The current edition of the UN standard is the 9<\/span><span style=\"font-weight: 400\">th<\/span><span style=\"font-weight: 400\"> edition. However, Canada will be in line with the USA \u2013 currently, the <a href=\"https:\/\/www.osha.gov\/dsg\/hazcom\/\" target=\"_blank\" rel=\"noopener noreferrer\">Occupational Safety and Health Administration (OSHA)<\/a><\/span><span style=\"font-weight: 400\"> is planning to issue a revision to its <a href=\"https:\/\/www.osha.gov\/dsg\/hazcom\/2012standard.html\" target=\"_blank\" rel=\"noopener noreferrer\">Hazard Communication Standard 2012<\/a><\/span><span style=\"font-weight: 400\"> that will be based on the GHS 7<\/span><span style=\"font-weight: 400\">th<\/span><span style=\"font-weight: 400\"> revision as well. A Notice of Proposed Rulemaking is expected sometime early this year from OSHA. Canada and the USA have worked together to identify areas of discrepancies between the two standards and eliminate them as much as possible.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Stakeholders have 70 days from the issue of the <\/span><i><span style=\"font-weight: 400\">Gazette I<\/span><\/i><span style=\"font-weight: 400\"> amendment to comment to Health Canada. If the amendment goes through as planned into <\/span><i><span style=\"font-weight: 400\">Canada Gazette II<\/span><\/i><span style=\"font-weight: 400\">, there would be a transition period of two years to allow industry to see if products require revised classifications and make any changes necessary to their products, labels, and SDSs. This will be an upfront cost, of course, of time and money, but will result in benefits such as increased harmonization with other markets, simplification of labels and SDSs, and more accurate hazard classification.<\/span><\/p>\n<p><span style=\"font-weight: 400\">So, don\u2019t forget to keep an eye on the progress of these changes. If you sell products under WHMIS in Canada, the passage of this amendment will result in at least minor changes to your hazard communication system.
