{"id":734349,"date":"2021-02-17T07:20:32","date_gmt":"2021-02-17T12:20:32","guid":{"rendered":"https:\/\/www.thecompliancecenter.com\/ca\/?p=734349"},"modified":"2025-09-05T09:15:32","modified_gmt":"2025-09-05T13:15:32","slug":"flammable-liquid-exceptions","status":"publish","type":"post","link":"https:\/\/www.thecompliancecenter.com\/ca\/help-center\/articles\/flammable-liquid-exceptions\/","title":{"rendered":"Flammable Liquid Exceptions"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-858034\" src=\"https:\/\/www.thecompliancecenter.com\/wp-content\/uploads\/2021\/02\/ICC_FlammableLiquid_Blog_2-2021.png\" alt=\"\" width=\"1001\" height=\"301\" \/><\/p>\n<p><span style=\"font-weight: 400\">Flammable Liquid, class 3, is one of the broadest hazard classes because it includes a variety of chemicals\u2014everything from paint, coatings, adhesives, hand sanitizers, jet fuel, and gasoline.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">We know that a class 3 is material with a flashpoint less than or equal to 60\u00b0C (140\u00b0F). Class 3 materials are divided into three packing groups, represented as follows:<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-858035\" src=\"https:\/\/www.thecompliancecenter.com\/wp-content\/uploads\/2021\/02\/ICC_FlammableLiquidExxceptions_001.png\" alt=\"\" width=\"735\" height=\"163\" \/><\/span><\/p>\n<p><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-mancfro-2020\/\" target=\"_blank\" rel=\"noopener noreferrer\">The United States 49 CFR<\/a><span style=\"font-weight: 400\"> has a unique classification called Combustible Liquid. A combustible liquid has a flashpoint of greater than 60\u00b0C (140\u00b0F) but not less than or equal to 93.3\u00b0C. Combustible liquids are only regulated in bulk (&gt;119 gallons).<\/span><\/p>\n<p><span style=\"font-weight: 400\">There are a number of exceptions outlined in the 49 CFR regulations for flammable liquids. These exceptions are found in <a href=\"https:\/\/www.law.cornell.edu\/cfr\/text\/49\/173.150\" target=\"_blank\" rel=\"noopener noreferrer\">CFR 49 Part 173.150<\/a><\/span><span style=\"font-weight: 400\">. Of course, the most common would be limited quantity.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Another, not as common is found at 173.150 (f)(1). The regulations state the following:<\/span><\/p>\n<p><i><span style=\"font-weight: 400\">(f) Combustible liquids. A flammable liquid with a flash point at or above 38 \u00b0C (100 \u00b0F) that does not meet the definition of any other hazard class may be reclassed as a combustible liquid. This provision does not apply to transportation by vessel or aircraft, except where other means of transportation is impracticable.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400\">This means, if you have a product that is classified as a flammable liquid, packing group III with a flashpoint above 38\u00b0C, you can ship your non-bulk package as not regulated. This is because 49 CFR 150 (f)(2) says:\u00a0\u00a0<\/span><\/p>\n<p><i><span style=\"font-weight: 400\">(2) The requirements in this subchapter do not apply to a material classed as a combustible liquid in a non-bulk packaging unless the combustible liquid is a hazardous substance, a hazardous waste, or a marine pollutant.<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400\">This exception could be beneficial to shippers, as they would not need a hazmat driver, nor would they pay the additional hazmat fee.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Are you interested in learning about more exceptions in the 49CFR or other regulations?
