But some are, thankfully, in the past. Remember when the Centres for Disease Control was giving instructions on how to create your own mask with a handkerchief and hair ties? Oh, and hand sanitizer was impossible to get. We\u2019ve come a long way. And some of the solutions for those issues will no longer be needed. By 2022, they\u2019ll be gone.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the early days of the pandemic, both the U.S. Department of Transportation (DOT) and Transport Canada had to address several issues. First, how would samples of the new COVID virus be transported, either for research or as testing samples? Second, how could they speed up the supply chain for hand sanitizers and disinfectants, which were suffering bottlenecks such as the lack of available UN specification packaging for containers that were too big to go as limited quantities? Finally, how could the training of workers, particularly refresher training, be carried out in a time when social distancing prevented face-to-face contact?<\/span><\/p>\n<h2><strong>U.S. Provisions \u2013 Most but Not All Have Expired<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">The U.S. addressed these issues by issuing \u201cNotices of Enforcement Discretion.\u201d These directed inspectors for the Pipeline and Hazardous Materials Administration (PHMSA) to allow certain activities to be allowed by inspectors during the critical time periods even when not in compliance with the Hazardous Materials Regulations of Title 49, Code of Federal Regulations (49 CFR). These have already expired:<\/span><\/p>\n<ul>\n<li><a href=\"https:\/\/www.phmsa.dot.gov\/sites\/phmsa.dot.gov\/files\/2020-04\/PHMSA%20Revised%20Hand%20Sanitizer%20Notice%20wLinks.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Reduced requirements for packaging and hazard communication for hand sanitizers<\/a><span style=\"font-weight: 400;\">\u00a0\u2013 Expired March 31, 2021<\/span><\/li>\n<li><a href=\"https:\/\/www.phmsa.dot.gov\/sites\/phmsa.dot.gov\/files\/2020-03\/PHMSA%20Enforcement%20Policy%20Notice%20-%20TRAINING%20update.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Variance of requirements for training (delayed expiry of certification)<\/a><span style=\"font-weight: 400;\"> \u2013 Expired October 31, 2020, for most workers; December 31, 2020, for maritime workers<\/span><\/li>\n<li><a href=\"https:\/\/www.phmsa.dot.gov\/news\/phmsa-notice-extension-enforcement-discretion-manufacturing-packaging-designs-beyond-periodic\" target=\"_blank\" rel=\"noopener noreferrer\">Extension of testing requirements for UN specification packaging<\/a><span style=\"font-weight: 400;\"> \u2013 Expired October 31, 2020.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">One notice still in effect is for <a href=\"https:\/\/www.phmsa.dot.gov\/sites\/phmsa.dot.gov\/files\/2021-09\/Reinstatement%20of%20PHMSA%20Cylinder%20Relief%20for%20COVID-19.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">extended test periods for compressed gas cylinders<\/a><\/span><span style=\"font-weight: 400;\">, which were further delayed by Hurricane Ida. This notice will be in effect until January 15, 2022.<\/span><\/p>\n<h2><strong>Canadian Temporary Certificates<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Transport Canada addressed special requirements for COVID issues by issuing \u201ctemporary certificates.\u201d Unlike normal certificates of equivalent level of safety, these could be used by any company who found them useful. A complete list of these certificates can be seen on Transport Canada\u2019s website <a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/span><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Two of these certificates have already expired \u2013 <a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07501-training\" target=\"_blank\" rel=\"noopener noreferrer\">TU07590.1, Training<\/a><\/span><span style=\"font-weight: 400;\">, which extended the allowed retraining period, and <a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07512-testing-inspection-requirements\" target=\"_blank\" rel=\"noopener noreferrer\">TU0751.2, Testing and Inspection Requirements<\/a><\/span><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07512-testing-inspection-requirements\"><span style=\"font-weight: 400;\">,<\/span><\/a><span style=\"font-weight: 400;\"> which gave an extension for retesting standardized packaging.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The remaining certificates are due to expire on December 31, 2021. These include:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\"><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07523-hand-sanitizer\" target=\"_blank\" rel=\"noopener noreferrer\">TU 0752.3: Hand sanitizers<\/a>, which gives relief of certain requirements for larger containers of hand sanitizers, such as reduced package markings and shipping document requirements, as well as relief from UN specification packaging.<\/span><\/li>\n<li><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07533-canada-post-corporation-shipping-hand-sanitizer-air\" target=\"_blank\" rel=\"noopener noreferrer\">TU 0753.3 Canada Post Corporation &#8211; Shipping hand sanitizer by air<\/a><span style=\"font-weight: 400;\">, which allowed Canada Post to use mail to deliver hand sanitizers by air mail with reduced requirements similar to TU 0742.3.<\/span><\/li>\n<li><span style=\"font-weight: 400;\"><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07542-transporting-hand-sanitizer-air\" target=\"_blank\" rel=\"noopener noreferrer\">TU 0754.2: Transporting hand sanitizer by air<\/a>, which permitted hand sanitizers to be shipped by air in quantities not permitted by the ICAO Technical Instructions for Safe Transport of Dangerous Goods by Air, and with reduced packaging and hazard communication. This was to facilitate getting hand sanitizers to areas without easily accessible ground transport.<\/span><\/li>\n<li><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/temporary-certificates\/temporary-certificate-tu-07641-test-samples-covid-19\" target=\"_blank\" rel=\"noopener noreferrer\">TU 0764.1 &#8211; Test samples for COVID-19<\/a><span style=\"font-weight: 400;\">, which allowed for an alternative way of shipping samples of COVID in Category B, Division 6.2, with reduced packaging.\u00a0<\/span><\/li>\n<\/ul>\n<h2><strong>Conclusion<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">These provisions have been essential in the early days of the pandemic to get essential safety supplies to consumers and workplaces and to allow COVID samples to be shipped legally when the normal packaging and marking wasn\u2019t available. However, the supply chain for products like sanitizers and disinfectants have grown to address these needs, and the certificates\/notices of enforcement aren\u2019t really necessary anymore. Therefore, we can return to shipping such hazardous materials using the standard protocols.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Do you need to ship consumer or industrial COVID supplies?
