Ces normes, si elles sont appliqu\u00e9es, auront un impact important sur le syst\u00e8me de formation et int\u00e9greront une version de la Formation bas\u00e9e sur la comp\u00e9tence qui a gagn\u00e9 en importance dans les milieux r\u00e9glementaires au cours des derni\u00e8res ann\u00e9es.<\/p>\n<h2><strong>En quoi consiste la Formation bas\u00e9e sur la comp\u00e9tence?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Tout d\u2019abord, qu\u2019est-ce qu\u2019est la Formation bas\u00e9e sur la comp\u00e9tence (FBC)? Comme l\u2019a expliqu\u00e9<\/span><a href=\"https:\/\/hrdailyadvisor.blr.com\/2017\/05\/25\/competency-based-training\/\"><span style=\"font-weight: 400;\"> Bridget Miller de HR Daily Advisor<\/span><\/a><span style=\"font-weight: 400;\">, \u00ab la formation bas\u00e9e sur la comp\u00e9tence est un type de formation ax\u00e9 sur des comp\u00e9tences ou des habilet\u00e9s sp\u00e9cifiques&#8230; Ces habilet\u00e9s sont regroup\u00e9es dans des modules et l\u2019apprenant re\u00e7oit habituellement \u00e0 la fin une forme de qualification ou de certification \u00bb. Essentiellement, il s\u2019agit d\u2019une approche syst\u00e9matique de la formation qui divise les t\u00e2ches en fonctions individuelles et qui s\u2019assure que les employ\u00e9s sont form\u00e9s et comp\u00e9tents dans chaque domaine de leurs fonctions. L\u2019\u00e9valuation doit \u00e9galement \u00eatre suffisamment compl\u00e8te pour v\u00e9rifier que les employ\u00e9s sont effectivement devenus comp\u00e9tents dans leurs fonctions et qu\u2019ils sont en mesure de les accomplir en toute l\u00e9galit\u00e9 et s\u00e9curit\u00e9.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Afin de permettre aux employeurs canadiens d&#8217;\u00e9laborer plus facilement des analyses de fonction et des plans d\u2019\u00e9valuation, l\u2019Office des normes g\u00e9n\u00e9rales du Canada (ONGC) a publi\u00e9 une norme concernant la<\/span><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/training-courses\/shipping-dangerous-goods-by-ground-in-canada\/\"><span style=\"font-weight: 400;\"> formation bas\u00e9e sur la comp\u00e9tence pour le transport des mati\u00e8res dangereuses<\/span><\/a><span style=\"font-weight: 400;\">. Vous pouvez t\u00e9l\u00e9charger une copie gratuite de la norme, CAN\/CGSB-192.3-2020, <\/span><i><span style=\"font-weight: 400;\">Transport des marchandises dangereuses \u2013 formation, \u00e9valuation et comp\u00e9tence<\/span><\/i><span style=\"font-weight: 400;\">, sur les Publications du gouvernement du Canada \u00e0 l\u2019adresse<\/span><a href=\"https:\/\/publications.gc.ca\/site\/eng\/9.893439\/publication.html\"><span style=\"font-weight: 400;\"> https:\/\/publications.gc.ca\/site\/fra\/9.893442\/publication.html<\/span><\/a><span style=\"font-weight: 400;\">. Ceci offre une description d\u00e9taill\u00e9e de ce qui est requis en mati\u00e8re de formation de sensibilisation g\u00e9n\u00e9rale et de formation propre aux fonctions pour le transport terrestre et a\u00e9rien, ainsi que des directives sp\u00e9cifiques sur la fa\u00e7on d\u2019\u00e9valuer la r\u00e9ussite du programme de formation.<\/span><\/p>\n<h2><strong>Quels sont les changements?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Il faut maintenant que les r\u00e9glementations sur le TMD rendent ceci officiel afin que les programmes canadiens de formation sur les mati\u00e8res dangereuses soient conformes \u00e0 la norme de l\u2019ONGC. C\u2019est l\u2019objectif de la proposition apparaissant dans la <\/span><i><span style=\"font-weight: 400;\">Gazette I<\/span><\/i><span style=\"font-weight: 400;\">. Celle-ci a trois objectifs principaux :<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400;\">retirer le terme actuel \u00ab ad\u00e9quatement form\u00e9 \u00bb de la Partie 6 des RTMD, qui est vague et assujetti \u00e0 diff\u00e9rentes interpr\u00e9tations;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">incorporer la norme CAN\/CGSB-192.3 en r\u00e9f\u00e9rence, pour remplacer \u00ab ad\u00e9quatement form\u00e9 \u00bb comme \u00e9tant d\u00e9termin\u00e9 sans encadrement de la part de l\u2019employeur; et<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u00e9tablir que pour \u00eatre consid\u00e9r\u00e9e comme \u00e9tant comp\u00e9tente pour manipuler, offrir le transport ou transporter des mati\u00e8res dangereuses, une personne doit recevoir deux types de formation : une formation de sensibilisation g\u00e9n\u00e9rale (une formation pour comprendre l\u2019objectif de base et les concepts du TMD) et une formation propre aux fonctions (formation portant sur le poste occup\u00e9 par l\u2019individu) et une \u00e9valuation.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">La proposition de la <\/span><i><span style=\"font-weight: 400;\">Gazette I<\/span><\/i><span style=\"font-weight: 400;\"> d\u00e9crit en profondeur dans son pr\u00e9ambule les changements anticip\u00e9s et les co\u00fbts estim\u00e9s pour les parties prenantes. La modification en soi est relativement courte puisque la plupart des exigences seront couvertes en r\u00e9f\u00e9rence dans la norme de l\u2019ONGC. La proposition n\u00e9cessitera une modification \u00e0 la Partie 6 portant sur la formation des RTMD qui sera effectu\u00e9e et \u00e9valu\u00e9e selon cette norme. D\u2019autres changements seront bas\u00e9s sur les r\u00e9sultats de cette norme. Par exemple, les certificats de formation devront contenir une liste des comp\u00e9tences reconnues du travailleur dans un format l\u00e9g\u00e8rement diff\u00e9rent du certificat de formation actuel.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La tenue de dossiers de formation doit \u00eatre mise \u00e0 niveau selon la nouvelle norme. L\u2019employeur doit actuellement tenir un dossier des personnes ayant re\u00e7u une formation, les documents utilis\u00e9s pour la formation et une copie du certificat \u00e9mis \u00e0 ceux qui ont \u00e9t\u00e9 reconnus comme \u00e9tant \u00ab ad\u00e9quatement form\u00e9s \u00bb. L\u2019\u00e9valuation formalis\u00e9e a \u00e9t\u00e9 effectu\u00e9e par plusieurs employeurs, mais n\u2019\u00e9tait pas requise dans la Partie 6. En vertu de la modification, \u00ab les employeurs doivent conserver des dossiers qui d\u00e9montrent que les employ\u00e9s ont \u00e9t\u00e9 form\u00e9s et \u00e9valu\u00e9s selon la norme de l\u2019ONGC, pendant deux ans suivant l\u2019expiration du certificat de comp\u00e9tence \u00bb. De ce fait, les employeurs doivent s\u2019assurer que leurs \u00e9valuations sont document\u00e9es et conserv\u00e9es avec les autres dossiers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Le changement le plus important \u00e0 la formation serait la division de la \u00ab sensibilisation g\u00e9n\u00e9rale \u00bb de la formation \u00ab propre aux fonctions \u00bb. Bien que la modification ne le mentionne pas directement, la norme de l\u2019ONGC exige que les travailleurs passent un test d\u00e9taill\u00e9 sur la portion de sensibilisation g\u00e9n\u00e9rale avant de passer \u00e0 la formation propre aux fonctions. Cela peut exiger de diviser la formation en deux parties distinctes, puisque ceux qui \u00e9chouent \u00e0 la formation sur la sensibilisation g\u00e9n\u00e9rale ne peuvent reprendre le test qu\u2019\u00e0 deux reprises. Si les candidats ne r\u00e9ussissent pas apr\u00e8s leur troisi\u00e8me essai, ils doivent suivre \u00e0 nouveau la formation sur la sensibilisation g\u00e9n\u00e9rale et reprendre le test jusqu\u2019\u00e0 ce qu\u2019ils obtiennent la note de passage avant de passer \u00e0 la formation propre aux fonctions. Puisque la plupart des cours de formation combinent les deux parties en une seule session, les proc\u00e9dures de formation devront \u00eatre repens\u00e9es et de nouveaux concepts devront \u00eatre appliqu\u00e9s.<\/span><\/p>\n<h2><strong>Quel est l\u2019\u00e9ch\u00e9ancier?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">N\u2019oubliez pas qu\u2019il ne s\u2019agit pas de la version finale de la modification et que ce n\u2019est qu\u2019une proposition afin d\u2019obtenir les commentaires du public. Rien ne sera final jusqu\u2019\u00e0 sa publication (avec les modifications n\u00e9cessaires en fonction des commentaires) dans la <\/span><i><span style=\"font-weight: 400;\">Gazette II du Canada<\/span><\/i><span style=\"font-weight: 400;\">. Transports Canada invite les personnes int\u00e9ress\u00e9es \u00e0 pr\u00e9senter leurs observations dans les 60 jours suivant la date de la publication (11 d\u00e9cembre 2021). Ces commentaires doivent citer la Gazette du Canada, Partie I et la date de la publication de l\u2019avis. Lorsque le tout sera officialis\u00e9, il y aura une p\u00e9riode de transition d\u2019un an avant que la nouvelle formation soit effectu\u00e9e selon la norme de l\u2019ONGC. De plus, cette modification n\u2019affectera pas les certificats actuels de formation. Ces derniers demeureront valides jusqu\u2019\u00e0 leur expiration. Une formation d\u2019actualisation et une certification seront ensuite effectu\u00e9es selon la nouvelle norme. Toutefois, l\u2019\u00e9ch\u00e9ancier demeure suffisamment court pour que les personnes impliqu\u00e9es dans la formation doivent bient\u00f4t commencer \u00e0 prendre en consid\u00e9ration les implications.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Au Centre de Conformit\u00e9 ICC, nous serons bien s\u00fbr en mesure de vous aider en fonction de vos besoins de formation.
