{"id":859914,"date":"2022-02-23T07:00:26","date_gmt":"2022-02-23T12:00:26","guid":{"rendered":"https:\/\/www.thecompliancecenter.com\/ca\/?p=859914"},"modified":"2025-09-08T00:34:23","modified_gmt":"2025-09-08T04:34:23","slug":"tdg-exemption-1-39","status":"publish","type":"post","link":"https:\/\/www.thecompliancecenter.com\/ca\/help-center\/articles\/tdg-exemption-1-39\/","title":{"rendered":"TDG Exemption 1.39"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-875909 size-full\" src=\"https:\/\/www.thecompliancecenter.com\/wp-content\/uploads\/2022\/02\/ICC_TDGExemption1.39_Blog_02-2022.png\" alt=\"\" width=\"1001\" height=\"301\" \/><\/p>\n<p><span data-contrast=\"auto\">A recent helpdesk call led me to investigate the exemption outlined in the <span style=\"font-weight: 400;\"><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product-category\/publications\/canadian-tdg\/\" target=\"_blank\" rel=\"noopener noreferrer\">Transportation of Dangerous Goods Regulations<\/a><\/span><\/span><span data-contrast=\"auto\">\u00a0called <\/span><b><span data-contrast=\"auto\">(<\/span><\/b><b><i><span data-contrast=\"auto\">1.39) Class 6.2, Infectious Substances, UN3373, BIOLOGICAL SUBSTANCE, CATEGORY B Exemption<\/span><\/i><\/b><b><span data-contrast=\"auto\">.<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The exception as outlined in the regulations state<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Part 3, Documentation, and Part 4, Dangerous Goods Safety Marks, except section 4.22.1, do not apply to the handling, offering for transport or transporting of infectious substances that are included in Category B if:<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><b><span data-contrast=\"auto\">(a)<\/span><\/b><span data-contrast=\"auto\">\u202f one external surface of the means of containment for the substances measures at least 100 mm \u00d7 100 mm;<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\"><br \/>\n<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><b><span data-contrast=\"auto\">(b)<\/span><\/b><span data-contrast=\"auto\">\u202f the means of containment is in compliance with Part 5, Means of Containment, and has displayed on the external surface<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><b><span data-contrast=\"auto\">(i)<\/span><\/b><span data-contrast=\"auto\">\u202f the mark illustrated in Part 4, Dangerous Goods Safety Marks, for infectious substances included in Category B, and<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><b><span data-contrast=\"auto\">(ii) <\/span><\/b><span data-contrast=\"auto\">\u202fthe shipping name, on a contrasting background, next to the mark in letters at least 6 mm high; and<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li data-leveltext=\"\uf0b7\" data-font=\"Symbol\" data-listid=\"1\" aria-setsize=\"-1\" data-aria-posinset=\"3\" data-aria-level=\"1\"><b><span data-contrast=\"auto\">(c)<\/span><\/b><span data-contrast=\"auto\">\u202f the 24-hour telephone number required under paragraph 3.5(1)(f) is displayed next to the shipping name on the means of containment.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/li>\n<\/ul>\n<p><span data-contrast=\"auto\">The helpdesk question involved (c) the 24-hour number \u2013 Can they use Canutec\u2019s number. I said no because the phone number needs to be the shipper. The shipper is the only one who would really be able to provide the technical information and properties about the substance in question.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Recently, Transport Canada added this exact scenario to their <span style=\"font-weight: 400;\"><a href=\"https:\/\/tc.canada.ca\/en\/dangerous-goods\/safety-awareness-materials-faq#a2_0\" target=\"_blank\" rel=\"noopener noreferrer\">FAQ Page<\/a>.\u00a0<\/span><\/span><\/p>\n<p><i><span data-contrast=\"auto\">Can I use CANUTEC&#8217;s phone number when using exemption 1.39?<\/span><\/i><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><i><span data-contrast=\"auto\">The 24-hour telephone number required by Paragraph 1.39(c) is the phone number of the consignor who is, in most cases, the only person able to provide technical information about the dangerous goods in transport.
