{"id":860061,"date":"2022-03-21T07:00:03","date_gmt":"2022-03-21T11:00:03","guid":{"rendered":"https:\/\/www.thecompliancecenter.com\/ca\/?p=860061"},"modified":"2022-03-21T07:01:28","modified_gmt":"2022-03-21T11:01:28","slug":"hm-215-enforcement-policy","status":"publish","type":"post","link":"https:\/\/www.thecompliancecenter.com\/ca\/help-center\/articles\/hm-215-enforcement-policy\/","title":{"rendered":"HM-215 \u2013 Enforcement Policy"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-876069 size-full\" src=\"https:\/\/www.thecompliancecenter.com\/wp-content\/uploads\/2022\/03\/ICC_PHMSAEnforcementPolicy_Blog_03-2022.png\" alt=\"\" width=\"1001\" height=\"301\" \/><\/p>\n<p><span data-contrast=\"auto\">Generally, once a year, the Pipeline and Hazardous Materials Safety Administration (PHMSA) publish a final rule called HM-215.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">This final rule\u2019s purpose is to align the <span style=\"font-weight: 400;\"><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product-category\/publications\/us-49-cfr\/\" target=\"_blank\" rel=\"noopener noreferrer\">49 CFR regulations<\/a><\/span><\/span><span data-contrast=\"auto\">\u00a0with the international regulations including International Civil Aviation Organization&#8217;s Technical Instructions for the Safe Transport of Dangerous Goods by Air <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/product\/bk-icao21\/\"><span data-contrast=\"none\">(<\/span><\/a><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-icao21\/\" target=\"_blank\" rel=\"noopener noreferrer\">ICAO Technical Instructions<\/a>)<span data-contrast=\"auto\"> and the International Maritime Organization, International Maritime Dangerous Goods Code <\/span><a href=\"https:\/\/www.thecompliancecenter.com\/product\/bk-imo1v20\/\"><span data-contrast=\"none\">(<\/span><\/a><a href=\"https:\/\/www.thecompliancecenter.com\/ca\/product\/bk-imo1v20\/\" target=\"_blank\" rel=\"noopener noreferrer\">IMDG Code<\/a>)<span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The 49 CFR Part 171.7 allows offerors and carriers to use the international regulations when preparing their shipments intended to ultimately ship via air or ocean.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">When the final rule (HM-215) is delayed, it causes shipper\u2019s concern, because the 49 CFR regulations specifically identify with the versions of said regulations.
