M\u00eame les organismes de r\u00e9glementation prennent des vacances, et les mois de juillet et ao\u00fbt sont des p\u00e9riodes o\u00f9 les effectifs sont r\u00e9duits dans les bureaux. La plupart des changements sont finalis\u00e9s avant le d\u00e9but des chaleurs, ou apr\u00e8s la f\u00eate du Travail. Ce juillet cependant, Transports Canada a r\u00e9ussi \u00e0 faire passer un dernier amendement au\u00a0<a href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/regulations\/sor-2001-286\/\"><em>R\u00e8glement sur le transport des marchandises dangereuses<\/em><\/a>\u00a0(RTMD) avant les vacances d\u2019\u00e9t\u00e9.<\/p>\n<h4>Quel est l&#8217;objectif de cet amendement?<\/h4>\n<p>Pour \u00eatre honn\u00eate, cet amendement est intitul\u00e9\u00a0<a href=\"https:\/\/canadagazette.gc.ca\/rp-pr\/p2\/2023\/2023-07-05\/html\/sor-dors155-eng.html\">R\u00e8glement correctif visant le R\u00e8glement sur le transport des marchandises dangereuses<\/a>, ne constitue pas un changement majeur. Comme son nom l&#8217;indique, il s&#8217;agit plut\u00f4t d&#8217;une s\u00e9rie de changements mineurs destin\u00e9s \u00e0 corriger des erreurs dans le texte, \u00e0 r\u00e9viser la terminologie juridique ou \u00e0 pr\u00e9ciser des informations. Selon Transports Canada, les objectifs sont les suivants\u00a0:<\/p>\n<ul>\n<li>\u00ab\u00a0abroger les dispositions r\u00e9glementaires d\u00e9su\u00e8tes qui n&#8217;ont pas d&#8217;application \u00e0 l\u2019heure actuelle;<\/li>\n<li>corriger les disparit\u00e9s entre les versions fran\u00e7aise et anglaise;<\/li>\n<li>harmoniser la terminologie utilis\u00e9e dans le RTMD avec celle utilis\u00e9e dans la loi ou les r\u00e8glements connexes;<\/li>\n<li>pr\u00e9ciser les dispositions existantes;<\/li>\n<li>corriger les erreurs typographiques, grammaticales, les fautes d\u2019orthographe, de num\u00e9rotation et de ponctuation;<\/li>\n<li>mettre \u00e0 jour les r\u00e9f\u00e9rences aux normes et autres documents incorpor\u00e9s par r\u00e9f\u00e9rence.\u00a0\u00bb<\/li>\n<\/ul>\n<p>La particularit\u00e9 de cet amendement est qu&#8217;il a \u00e9t\u00e9 publi\u00e9 directement dans la\u00a0<a href=\"https:\/\/www.gazette.gc.ca\/accueil-home-eng.html\"><em>Gazette du Canada Partie II<\/em><\/a>, ce qui signifie qu&#8217;il est en vigueur depuis le jour de la publication (5\u00a0juillet\u00a02023). Apparemment en raison de l&#8217;effet limit\u00e9 de ces changements, Transports Canada a choisi de ne pas publier d&#8217;avant-projet pour commentaires publics dans la\u00a0<em>Gazette du Canada Partie\u00a0I<\/em>. Bien que cela soit inhabituel, cela signifie que ceux d&#8217;entre nous qui sont impliqu\u00e9s dans la conformit\u00e9 r\u00e9glementaire n&#8217;ont pas \u00e0 passer l&#8217;\u00e9t\u00e9 \u00e0 examiner la proposition et \u00e0 faire des commentaires.<\/p>\n<h4>D\u00e9composons les d\u00e9tails<\/h4>\n<p>Quels sont donc les changements apport\u00e9s par cette modification? M\u00eame si aucune r\u00e9vision importante de vos proc\u00e9dures de transport n&#8217;est \u00e0 pr\u00e9voir, les mises \u00e0 jour terminologiques et les d\u00e9tails mineurs doivent tout de m\u00eame \u00eatre examin\u00e9s afin de d\u00e9terminer les r\u00e9percussions qu&#8217;elles pourraient avoir sur vos activit\u00e9s.<\/p>\n<ul>\n<li>Tout d&#8217;abord, pour faciliter la lecture, les r\u00e9f\u00e9rences aux titres des parties ont \u00e9t\u00e9 \u00e9limin\u00e9es du texte. Par exemple, si la section se r\u00e9f\u00e9rait \u00e0 l&#8217;origine \u00e0 la \u00ab\u00a0Partie 3 (Documentation)\u00a0\u00bb, la section se lira d\u00e9sormais simplement \u00ab\u00a0Partie 3\u00a0\u00bb.<\/li>\n<li>En outre, lorsqu&#8217;il est fait r\u00e9f\u00e9rence aux fonctions de l&#8217;administration de Transports Canada, le r\u00e8glement fait d\u00e9sormais simplement r\u00e9f\u00e9rence au \u00ab\u00a0ministre\u00a0\u00bb(c&#8217;est-\u00e0-dire au ministre des Transports) plut\u00f4t qu&#8217;\u00e0 d&#8217;autres entit\u00e9s comme le directeur g\u00e9n\u00e9ral de la Direction g\u00e9n\u00e9rale du transport des marchandises dangereuses. Cela permet d&#8217;assurer l&#8217;harmonisation avec les exigences de la\u00a0<em>Loi sur le transport des marchandises dangereuses\u00a0<\/em>(LTMD), qui fait exclusivement r\u00e9f\u00e9rence au ministre.<\/li>\n<li>Certaines d\u00e9finitions ont \u00e9t\u00e9 remplac\u00e9es par une nouvelle terminologie, notamment\u00a0:\n<ul>\n<li>\u00ab\u00a0Marque de certification de s\u00e9curit\u00e9\u00a0\u00bb est remplac\u00e9 par la \u00ab\u00a0marque de conformit\u00e9\u00a0\u00bb d\u00e9j\u00e0 d\u00e9finie dans la LTMD.<\/li>\n<li>\u00ab\u00a0Marque de s\u00e9curit\u00e9 des marchandises dangereuses\u00a0\u00bb est remplac\u00e9 par la \u00ab\u00a0marque pour les marchandises dangereuses\u00a0\u00bb comme d\u00e9fini dans la<\/li>\n<li>Le terme \u00ab\u00a0importation\u00a0\u00bb a \u00e9t\u00e9 supprim\u00e9, car il ne figure plus dans la LTMD depuis 2009.<\/li>\n<li>\u00ab\u00a0Permis pour un niveau de s\u00e9curit\u00e9 \u00e9quivalent\u00a0\u00bb a \u00e9t\u00e9 remplac\u00e9e par \u00ab\u00a0Certificat d&#8217;\u00e9quivalence\u00a0\u00bb, comme utilis\u00e9 dans la LTMD.<\/li>\n<li>Les termes \u00ab\u00a0marque de s\u00e9curit\u00e9\u00a0\u00bb et \u00ab\u00a0moyens de confinement normalis\u00e9s\u00a0\u00bb ont \u00e9t\u00e9 supprim\u00e9s de la section 1.4 du RTMD, car ils sont d\u00e9j\u00e0 d\u00e9finis dans la loi.<\/li>\n<\/ul>\n<\/li>\n<li>Un changement mineur consiste \u00e0 ce que l&#8217;ordre des fonctions dans les sections \u00e9non\u00e7ant les responsabilit\u00e9s soit toujours \u00ab\u00a0offre pour le transport, manipulation ou transport de marchandises dangereuses\u00a0\u00bb, de sorte que certaines des sections modifi\u00e9es impliqueront simplement un r\u00e9arrangement des mots dans le texte.<\/li>\n<li>\u00c9tant donn\u00e9 que la partie\u00a08, Exigences de d\u00e9claration, n&#8217;utilise plus le mot \u00ab\u00a0accidentel\u00a0\u00bb pour les rejets \u00e0 d\u00e9clarer, ce mot a \u00e9t\u00e9 supprim\u00e9 des sections applicables, ne laissant que le mot \u00ab\u00a0rejet\u00a0\u00bb.<\/li>\n<li>Pour une meilleure harmonisation avec les r\u00e8glements internationaux et la LTMD, les mots \u00ab\u00a0risque\u00a0\u00bb et \u00ab\u00a0risqu\u00e9e\u00bb ont \u00e9t\u00e9 remplac\u00e9s par \u00ab\u00a0danger\u00a0\u00bb et \u00ab\u00a0dangereux\u00bb.<\/li>\n<\/ul>\n<h4>Changements importants dans l&#8217;utilisation du RTMD<\/h4>\n<p>Cet amendement comporte quelques changements qui auront un effet plus important sur le fonctionnement des r\u00e8glements. Soit\u00a0:<\/p>\n<ul>\n<li>\u00ab\u00a0L\u2019exemption de 500\u00a0kilogrammes\u00a0\u00bb dans la section\u00a01.16 a \u00e9t\u00e9 modifi\u00e9e pour ajouter la possibilit\u00e9 d&#8217;utiliser des \u00e9tiquettes sur les emballages si elles sont conformes \u00e0 la\u00a0<em>Loi canadienne sur la s\u00e9curit\u00e9 des produits de consommation<\/em>(LCSPC). Les produits \u00e9tiquet\u00e9s comme produits de consommation dangereux en vertu du \u00ab\u00a0R\u00e8glement sur les produits chimiques et contenants de consommation, 2001\u00a0\u00bb (RPCCC) pourront ainsi \u00eatre transport\u00e9s sans les marques et \u00e9tiquettes de s\u00e9curit\u00e9 du RTMD.<\/li>\n<li>Le paragraphe 3.5(3)(a) sur la documentation des conteneurs fumig\u00e9s a \u00e9t\u00e9 modifi\u00e9 pour changer la d\u00e9signation de transport de \u00ab\u00a0FUMIGATED UNIT\u00a0\u00bb ou \u00ab\u00a0ENGIN SOUS FUMIGATION\u00a0\u00bb \u00e0 \u00ab\u00a0FUMIGATED CARGO TRANSPORT UNIT\u00a0\u00bb ou \u00ab\u00a0ENGIN DE TRANSPORT SOUS FUMIGATION\u00a0\u00bb. Cela correspond \u00e0 la terminologie utilis\u00e9e actuellement dans les\u00a0<em>Recommandations de l&#8217;ONU sur le transport des marchandises dangereuses<\/em>.<\/li>\n<li>L&#8217;appellation r\u00e9glementaire associ\u00e9e \u00e0 l&#8217;UN2264 a \u00e9t\u00e9 modifi\u00e9e et passe de \u00ab\u00a0DIMETHYLCYCLOHEXYLAMINE\u00a0\u00bb \u00e0 \u00ab\u00a0<em>N,N-<\/em>DIMETHYLCYCLOHEXYLAMINE\u00a0\u00bb pour refl\u00e9ter l&#8217;usage international actuel.<\/li>\n<\/ul>\n<h4>Nettoyage du texte<\/h4>\n<p>Enfin, de nombreux nettoyages de sections et d&#8217;informations obsol\u00e8tes ont \u00e9t\u00e9 effectu\u00e9s, notamment\u00a0:<\/p>\n<ul>\n<li>Les sections 1.1 (Entr\u00e9e en vigueur) et 1.2 (Abrogation) ont \u00e9t\u00e9 supprim\u00e9es. Elles font r\u00e9f\u00e9rence \u00e0 des p\u00e9riodes de transition bas\u00e9es sur l&#8217;introduction du RTMD en 1985 et ne sont plus pertinentes.<\/li>\n<li>Les paragraphes 1.17(6) et 1.17(7) ont \u00e9t\u00e9 supprim\u00e9s. Ils faisaient r\u00e9f\u00e9rence \u00e0 des p\u00e9riodes transitoires de marquage de quantit\u00e9s limit\u00e9es qui sont d\u00e9sormais r\u00e9volues.<\/li>\n<li>Dans le paragraphe 1.3(3), les r\u00e9f\u00e9rences \u00e0 \u00ab\u00a0livres par pouce carr\u00e9\u00a0\u00bb et \u00ab\u00a0psig\u00a0\u00bb ont \u00e9t\u00e9 supprim\u00e9es. Il s&#8217;agit de mesures non m\u00e9triques qui ne sont plus utilis\u00e9es.<\/li>\n<li>Le paragraphe 3.6.1(1) est reformul\u00e9 pour supprimer la r\u00e9f\u00e9rence \u00e0 \u00ab\u00a0\u00c0 partir du 15\u00a0juillet 2015\u00a0\u00bb, puisque cette date est d\u00e9pass\u00e9e.<\/li>\n<li>La r\u00e9f\u00e9rence au \u00ab\u00a0R\u00e8glement relatif \u00e0 l&#8217;inspection des petits navires de p\u00eache\u00a0\u00bb (d\u00e9sormais abrog\u00e9) est remplac\u00e9e par l&#8217;actuel \u00ab\u00a0R\u00e8glement relatif \u00e0 la s\u00e9curit\u00e9 des navires de p\u00eache\u00a0\u00bb.<\/li>\n<li>Dans \u00ab\u00a0l\u2019exemption relative aux explosifs\u00a0\u00bb figurant \u00e0 la section\u00a01.31, le texte faisant r\u00e9f\u00e9rence \u00e0 la mesure par \u00ab\u00a0quantit\u00e9 nette d&#8217;explosifs\u00a0\u00bb a \u00e9t\u00e9 supprim\u00e9, car il ne fait que reprendre le texte figurant dans la l\u00e9gende de l&#8217;annexe\u00a01. Ce texte devrait \u00eatre suffisamment clair sans \u00eatre r\u00e9p\u00e9t\u00e9 dans la section 1.31.<\/li>\n<li>La disposition particuli\u00e8re 155 a \u00e9t\u00e9 modifi\u00e9e pour faire r\u00e9f\u00e9rence \u00e0 la section 7.1.5 des\u00a0<em>recommandatioins de l\u2019ONU<\/em>au lieu de 7.1.6, en raison d&#8217;un changement au niveau des Nations unies.<\/li>\n<li>Les r\u00e9f\u00e9rences au \u00ab\u00a0R\u00e8glement sur l&#8217;emballage et le transport des substances nucl\u00e9aires\u00a0\u00bb ont \u00e9t\u00e9 remplac\u00e9es par des r\u00e9f\u00e9rences \u00e0 la version la plus r\u00e9cente, le \u00ab\u00a0R\u00e8glement sur l&#8217;emballage et le transport des substances nucl\u00e9aires, 2015\u00a0\u00bb.<\/li>\n<li>Quelques petites erreurs typographiques ont \u00e9t\u00e9 corrig\u00e9es et des modifications mineures ont \u00e9t\u00e9 apport\u00e9es pour am\u00e9liorer l&#8217;harmonisation entre les textes fran\u00e7ais et anglais. Par exemple, l&#8217;appellation r\u00e9glementaire fran\u00e7aise de l&#8217;UN1082 contenait la faute d&#8217;orthographe \u00ab\u00a0RERIG\u00c9RANT\u00a0\u00bbqui a \u00e9t\u00e9 remplac\u00e9e par \u00ab\u00a0R\u00c9FRIG\u00c9RANT\u00a0\u00bb.<\/li>\n<\/ul>\n<h4>Conclusions<\/h4>\n<p>Cet amendement n&#8217;apporte pas beaucoup de changements majeurs, mais il corrige un certain nombre d&#8217;exigences obsol\u00e8tes, d&#8217;erreurs typographiques et d&#8217;erreurs simples qui \u00e9taient source d&#8217;irritation pour les exp\u00e9diteurs, les transporteurs et les destinataires. Ces changements contribueront \u00e0 rendre le RTMD aussi facile \u00e0 utiliser que possible. Alors qu&#8217;ils auraient pu \u00eatre incorpor\u00e9s dans d&#8217;autres amendements plus importants, cela signifie maintenant que lorsque des amendements plus importants (comme l\u2019<a href=\"https:\/\/www.gazette.gc.ca\/rp-pr\/p1\/2021\/2021-12-11\/html\/reg2-eng.html\">amendement sur la formation<\/a>\u00a0ou l\u2019<a href=\"https:\/\/www.gazette.gc.ca\/rp-pr\/p1\/2022\/2022-11-26\/html\/reg3-eng.html\">amendement sur l\u2019harmonisation<\/a>) sont publi\u00e9s, ils ne sont pas combin\u00e9s \u00e0 de nombreux Barbara is the author of ICC\u2019s TDG Clear Language Driver and Handler\u2019s Guide.
